Introduction
These Terms govern access to and use of the Delphina platform operated by Minith Labs Ltd. By creating an account or using the platform you accept these Terms in full. If you do not agree, do not use the service.
No Financial Advice
Delphina is not authorised by the Financial Conduct Authority (FCA). Nothing within the platform constitutes advice or a recommendation to buy, sell or act on any financial product. Decisions are your own responsibility.
Educational Use Only
Delphina provides tools, forecasts and information for general educational purposes. Content must not be relied upon as financial, investment, legal or tax advice.
Terms of Service
Data Accuracy and Forecasts
We aim to provide accurate information, though data, balances and projections may include delays, omissions or errors. Forecasts are estimates, not guarantees of outcome. Past performance is not indicative of future performance.
Subscriptions, Billing and Cancellation
Some features require a subscription. Payment is taken in advance. Subscriptions renew automatically unless cancelled before renewal. You may cancel or downgrade at any time in account settings. Access continues until the end of the paid period. Refunds for unused time are not issued unless required by law. Pricing may change; notice will be provided in advance.
Cooling Off and Refund Rights
Consumers in the UK may have a 14-day cooling-off period for digital services. By accessing paid features immediately, you acknowledge that the service is delivered at point of purchase and waive the right to a refund unless required by law.
User Responsibilities
You must keep login credentials secure, ensure information you provide is accurate and use the platform lawfully. You are responsible for your own financial decisions.
Acceptable Use
Users must not distribute harmful content, harass others, upload illegal data, attempt to hack or reverse engineer the platform, scrape or bulk-extract data, or use Delphina commercially without permission. Breaches may result in suspension or termination.
Intellectual Property
All software, design, content, text, graphics, algorithms and branding belong to Minith Labs Ltd. You receive a personal, revocable license for private use only.
Third-Party Services and Data
Delphina may integrate with external services. We do not guarantee their accuracy or availability and do not accept liability for third-party content, errors or downtime.
Privacy and Data Protection
Personal data is processed under our Privacy Policy and GDPR. By using the platform you consent to data processing as described.
User Data Ownership and Anonymised Use
You retain ownership of data you input. You grant Minith Labs Ltd license to store and process it for operation of the service. We may use aggregated and anonymised data for analytics, product development, commercial purposes or research. Such data will not personally identify users.
Data Retention and Deletion
Users may request account deletion. Personal data may remain in backups for up to 90 days, or longer if required for legal or compliance purposes.
Experimental and Beta Features
Some features may be released as beta or experimental. These may be incomplete, change without notice or contain errors. Use is at your own risk.
Service Availability
The platform may be updated or interrupted for maintenance or operational reasons. Continuous availability is not guaranteed.
Liability Limitation
Use of Delphina is at your own risk. Minith Labs Ltd is not liable for any loss or damage arising from use, including reliance on information, inaccurate data, downtime or decisions made. This includes direct, indirect, consequential and incidental losses, to the fullest extent permitted by law.
Indemnity
Users agree to indemnify Minith Labs Ltd for losses arising from breach of these Terms or misuse of the service.
Tax Responsibility
Users are responsible for reporting and paying any taxes arising from use of the platform or associated financial activity.
Account Suspension or Termination
We may suspend or terminate accounts for breach of Terms or if continued use is commercially or operationally unfeasible. We may refuse service at our discretion.
Price Changes
Subscription pricing may change. Notice will be provided in advance. Continued use after the effective date constitutes acceptance.
Marketing and Communications
By registering an account you may receive service emails. Where required, marketing communications operate on an opt-in basis and can be opted out at any time.
Force Majeure
We are not responsible for failure to provide service due to events beyond reasonable control, including outages, strikes, war, natural disasters or internet failure.
Modifications to Terms
We may update these Terms periodically. Updates become effective when posted. Continued use indicates acceptance of revised terms.
Governing Law
These Terms are governed by the laws of England and Wales. Legal disputes will be resolved exclusively in courts of England and Wales.
